WARRANTY/DISCLAIMER:

Peak disclaims all other warranties, expressed or implied, regarding the work, services, results or products associated with the work. All radon warranty testing will be done by one of the following methods to invoke the warranty:

  • Fans and sump pumps are warranted by their manufacturer under five (5) year warranty.

Festa Manufacturing Enterprises (“FME”) warrants that the AMG FANS shall be free from defects in material and workmanship for a period of (5) years from the date of purchase by the customer. If within the applicable warranty period the Products prove to be defective by reason of faulty workmanship or materials, FME will undertake to have the defective Product (or any part thereof) replaced at no cost to the customer subject to the following conditions:

Peak warrants that the Radon Mitigation system described in the Scope of Work will reduce radon levels within the home to below 4.0 pCi/L or less for the life of the system, so long as the system is functioning. Fans and sump pumps will be warranted by their manufacturer, only, and Peak disclaims all other warranties, express or implied, regarding the work, services, results or products associated with the work.

All radon warranty testing will be done will be done by one of the following methods to invoke the warranty:

  • Four short-term tests over each season, averaged;

  • One alpha tract test over a minimum of six months;

  • A minimum 48-hour continuous monitor test performed by NEHA certified testing company.

Peak Environment will repair or replace any parts found to be defective from normal use during this period. A service charge of $150.00 will be billed to the client for fan replacements after (3) three months.

Seller warrants the replacement or repair only for the unexpired portion in the original warranty. This warranty DOES NOT apply if damage occurs because of accident, physical abuse, act of God, earth movement, neglect, alteration, modification, or civil disturbances. ALL LIABILITY FOR ANY INCIDENT OR CONSEQUENTIAL DAMAGES OR ANY OTHER LOSSES OR DAMAGES INCURRED IN CONNECTION WITH THE PURCHASE, USE, REPLACEMENT OR REPAIR OF THE MITIGATION SYSTEM IS DISCLAIMED AND EXCLUDED HERE FROM. ALL PRICES ARE SUBJECT TO CHANGE.

LIMITATION OF LIABILITY: Peak’s liability for breach of contract, negligence, errors, omissions or any failure to perform is limited to the amount paid by Client, and Client will accept a refund of amounts paid in full satisfaction of any and all claims that it has or may have against Peak. Any claim arising from this agreement must be brought within 12 months of the completion of the work.

WAIVER OF CERTAIN DAMAGES AND SUBROGATION: Client holds Peak harmless and waives any and all claims for personal injury or property damage, as well as any and all claims for consequential, incidental, special, exemplary or punitive damages, based upon any theory of liability, and waives all rights against Peak for damages by any cause to the extent covered by property insurance.

PERFORMANCE STANDARDS: Radon is a pressurized soil gas that is caused by the breakdown of uranium in the soil beneath your home. Therefore, the only way to effectively remove it from your home is by creating the opposite effect under the slab. That is what a radon mitigation system does: It depressurizes the gases that rise in the soil and pulls them out of the home so they are no longer a threat to your family. We will install such a system in your home as described in the Scope of Work.

INSURANCE:

Peak Environment agrees to maintain applicable insurance for all tasks that are performed. At minimum, the following insurance coverage will be maintained:

General Liability: $1,000,000.00

Occurrence Form Contractors Pollution Liability: $1,000,000.00

Claims Made Professional Liability: $1,000,000.00

Claims Made Peak Environment will furnish a Certificate of Insurance upon request. If CLIENT requests increased insurance coverage, Peak Environment will purchase additional insurance, if obtainable, at Client’s expense.

ESTIMATED COSTS:

Peak will supply all transportation, labor, materials, equipment, disposal and insurance to complete scope of work of mitigation system purchased- $1,200.00 for the base radon mitigation installation and additional stated costs for system accessories. It is understood and agreed that there may be additional work required entailing additional costs depending on conditions found during the performance of the work. Peak will not perform any additional work absent written authorization from the client. Any additional work performed will be subject to the same terms, conditions, provisions and limitations as described herein. The price quoted is valid for 10 days, after which this offer is withdrawn. The amount charged is based upon the Scope of Work and all of the terms, conditions, provisions and limitations described herein.

SCHEDULE FOR COMPLETION:

The scope of work and overall pricing is based on completion of all on-site work activities in one (1) consecutive phase with completion of all mitigation activities within approximately one (1) work day.

PAYMENT:

Payment is due in full at completion of work. We accept checks and all major credit cards. Peak does not deal with third parties and Client is solely responsible for payment irrespective of any arrangements, Client may have with insurance companies, escrow agents or other third parties. Estimated cost applies only if paid on the day of installation. $150 fee applies if canceled within 24-hours of install. Peak institutes legal, equitable or other remedies to collect any unpaid balance, Client will be responsible for all costs and expenses associated therewith, including attorney fee.
